[ Ms. Juin Dutta Chakraborty Mr. Bidan Modak …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for direction upon the learned Civil Judge (Junior Division), 1st Court at Barrackpore, to dispose of the injunction application filed in connection Title Suit No. 235 of 2022 as also the title suit expeditiously. From the order sheets appended to this application, this Court finds that 20th July, 2026 has been fixed for hearing of the injunction application. The learned advocate appearing for the petitioner submits that the injunction application is otherwise ready for hearing. She further submits that the hearing of the said suit was adjourned on several occasions on the ground of the plaintiff/opposite party herein. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite parties forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Barrackpore, to take up the hearing of the injunction application on the next date fixed i.e. on 20th July, 2026, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 12 weeks from the next date fixed, without granting any unnecessary adjournments to either of the parties. After disposal of the said injunction application, the learned trial judge shall make all endeavour to dispose of the Title Suit No. 235 of 2022 as expeditiously as possible, without granting any unnecessary adjournments to either of the parties.
