The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ or order in the nature of certiorari for quashing the action of respondents for mentioning the amount of Rs.8,00,791/- in enclosure of form Pen-4 for recovery from the petitioner and Noornisha (second wife) without giving any opportunity of hearing in spite of fact that no departmental proceedings are pending. Further praying for issuance of a writ in the nature of mandamus directing respondents to release all the benefits along with PUNEET CHAWLA 2026.07.13 13:57 I attest to the accuracy and integrity of this document

pensionary benefits, as per the order dated 28.10.2025 (Annexure P-4) passed by respondent No.2, wherein, it has been specifically observed payment of amount of ex-gratia grant, compassionate financial assistance, family pension, death-cum-retirement gratuity, final payment of GPF and leave encashment be released. Further during the pendency of present writ petition respondents be restrained from deducting/recovering any amount from above mentioned benefits.

Learned State Counsel, at the very outset, submits that the grievance raised by the petitioner in the present writ petition stands redressed. It is submitted that the disciplinary proceedings initiated against the petitioner have been dropped and her retiral benefits, including Death- cum-Retirement Gratuity (DCRG), shall be released expeditiously in terms of the written instructions dated 09.07.2026, produced before this Court today and taken on record as Mark 'X'. A copy thereof has been supplied to
learned counsel for the petitioner.

In view of the aforesaid written instructions dated 09.07.2026 (Mark 'X') and the statement made by learned State Counsel, the present writ petition is disposed of with a direction to the respondents/competent authority to release the admissible retiral benefits of the petitioner, including DCRG, and to settle all her retiral dues, if not already released, within a period of eight weeks from the date of receipt of a certified copy of this
order.
