1. Mr. Vaibhav Singh Chauhan, learned counsel for the petitioner. 2. Mr. Tumul Nainwal, learned A.G.A. for the State. 3. Mr. Abhishek Joshi, learned counsel for the complainant. 4. By the instant petition, the petitioner Paras Verma S/o Uday Singh and Uday Singh S/o Ram Singh are praying for the following reliefs. “(i) Issue a writ, order or direction in the nature of certiorari to quash the impugned FIR No. 29 of 2026 dated 30.01.2026 U/s 376(2)(n) & 506 of IPC and U/s 3(1)(r) of SC/ST Act, lodged at P.S. Ranipur, district Haridwar, Uttarakhand, against the petitioner. (ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to not to arrest the petitioner in pursuance to the impugned FIR No. 29 of 2026 dated 30.01.2026 U/s 376(2)(n) & 506 of IPC and U/s 3(1)(r) of SC/ST Act, lodged at P.S. Ranipur, district Haridwar, Uttarakhand, against the petitioner.”

It is argued that with the allegations of false pretext of marriage the FIR has been lodged and on 7.02.2026 the petitioner no.1 married with another lady and now the respondent no.4 the complainant/victim also decided to marry with another person. This petition is supported with the compounding application, wherein it is contended that they have settled all their disputes due to interference by the elderly members of the society and their family members. Both the petitioners are present in Court and are identified by their counsel. The respondent no.4 joined the
2026:UHC:1553 proceedings through V.C. and also identified by her counsel through their Aadhar Cards. This Court also interact with respondent no.4 and on interaction she submits that she settled all the disputes with the petitioners and as such she does not want to proceed further with the impugned FIR and want to close the proceedings. 6. On the other side, Mr. Tumul Nainwal, the learned A.G.A. submits that the offences in which the FIR has been registered are non- compoundable, but the FIR is still under investigation and since the complainant herself settled the disputes with the petitioners, there is no useful purpose to go with the investigation. 7.
In such view of the matter, when the parties are settled their disputes and the respondent no.4/victim does not want to pursue the impugned FIR, this Court is of the view that the compounding application as well as writ petition are liable to be allowed. 8. Accordingly, the writ petition as well as the compounding application are allowed and the impugned FIR dated 30.01.2026 bearing FIR No. 29 of 2026, P.S. Ranipur, District Haridwar is hereby quashed.
