The Court made the following:
ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.45 of 2018 of Annavaram Police Station, East Godavari District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Section 489-B and 489-C of the Indian Penal Code,1860 (for brevity ‘the IPC’). 2. Heard the learned counsel for the Petitioner/Accused No.1 and Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor representing the State. 3. As the petitioner had not attended before the concerned Magistrate, a Non-Bailable Warrant was issued and later the Prathipadu Police executed the Non-Bailable Warrant and produced him before the learned Judicial Magistrate of First Class, Prathipadu, on 12.03.2026. The learned Magistrate sent the Petitioner/Accused No.1 to judicial custody. He has been in judicial custody for the past 95 days. As the petitioner did not attend before the learned Magistrate on 02.03.2026, the learned Magistrate issued a Non- Bailable Warrant. The allegation against the petitioner is that he exchanged fake currency notes of Rs.2,000/- denomination worth Rs.1,00,000/-. It is subject matter of case in Crime No.45 of 2018, which culminated in PRC No.11 of 2021 of Annavaram Police Station. If some stringent conditions are

imposed for enlarging the petitioner on bail, the ends of justice would be sub- served, driving the petitioner to appear before the learned Magistrate or the Trial Judge. 4. Considering the entire facts and circumstances of the case, and in view of the fact that the petitioner has got a permanent abode, this Court is inclined to enlarge the petitioner/Accused No.1 on bail. 5.
In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.1 shall be enlarged on bail, subject to his executing bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like sum each, to the satisfaction of the learned VII Additional District Judge (FTC), Peddapuram, East Godavari District. ii.
