JUSTICE GIRIJISH KUMAR ORAL ORDER 2 22-07-2026 Heard the learned counsel for the petitioner and the learned APP for the State. 2. The petitioner seeks bail in connection with Muzzafarpur Excise P.S. Case No. 1102 of 2026, registered under Section 30(a)/32(3) of the Bihar Prohibition and Excise Act. 3. As per the allegation in the FIR, total 4199.52 liters of Indian made foreign liquor including Bear was recovered from the Eicher truck bearing registration no. BR06-BF-7208. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. The petitioner is in custody since 20.06.2026 and 4199.52 liters of Indian made foreign liquor including Beer has been recovered from the truck bearing registration no. BR06-BF- Patna High Court CR. MISC. No.50298 of 2026(2) dt.22-07-2026 2/2 7208. The petitioner is the co-driver of the truck and he has no concern with the alleged recovery. Therefore, the petitioner who is of clean antecedent, deserves the privilege of regular bail. 5. Learned APP for the State vehemently opposes the prayer for grant of bail to the petitioner. 6. Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise 2nd, Muzaffarpur in connection with Muzzafarpur Excise P.S.
