1. Heard on admission.

This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, the BNSS) for grant of regular bail to the applicants who have been arrested in connection with Crime No. 89/2025 registered at Police Station – Dondhi, Dist. As per the prosecution’s case, on the intervening night between 07.07.2025 and 08.07.2025, the present applicants along with co- accused person assaulted the deceased Preetram Gota with firsts, kicks and stones causing him grievous injuries and due to such assault, the Preetram Gota succumbed to the injuries. Based on this, the offence under the aforesaid sections has been registered against them.
4. Learned counsel for the applicant submits that the applicants have not committed any offence and they have been falsely implicated in this case. She further submits that not even piece of stone or wooden stick was seized from the present applicants and the F.I.R. was lodged against unknown persons. She further submits that out of 23 prosecution witnesses, 11 witnesses were examined and they have not stated with regard to involvement of the applicants. She further submits that the applicants are in jail since 09.07.2025 and that trial is going on and it may take some time to conclude. On these premises, she prays for the grant of regular bail to the applicants.
5. On the other hand, learned counsel for the State opposes the
submissions of the learned counsel for the applicants and submits that the present applicants along with other co-accused person were involved in commission of murder of Preetram Gota and pursuant to the memorandum statement of the applicants, one mobile phone and motorcycle, which were used to commit the crime, were seized and that, the other prosecution witnesses are yet to be examined, therefore, at this stage, it is not just and proper to grant bail to the applicants and the bail application is liable to be dismissed.

6. I have heard learned counsel appearing for the parties and perused the case diary.
7. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of the offence and taking into account that the trial is going on, I am not inclined to release the applicants on bail.
8. Accordingly, the application filed under Section 483 of B.N.S.S. is rejected at the admission stage.
9. Office is directed to send a certified copy of this order to the trial Court concerned for information. Sd/-
