1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing the petitioner expresses dissatisfaction with regard to investigating criminal prosecution being Nodakhali Police Station Case No. 134 dated 14th March, 2025. It is further submitted on behalf of the petitioner that concerned police authorities are required to investigate with circumspection and alacrity.
3. State respondents and respondent no. 6 are represented by learned advocates.
4. Having considered the case made out on behalf of the petitioner, it appears that petitioner is not satisfied with the steps taken by the concerned police authorities in the aforesaid criminal prosecution in course of investigation which requires the petitioner to approach
2 jurisdictional magistrate within the statutory framework as it was decided by the Hon’ble Supreme Court reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar v. State of Maharashtra & Ors.).
5. Hence, writ petition is not interfered with and same stands dismissed.
6. However, this order shall not preclude the petitioner to approach the jurisdictional magistrate in pursuit of remedy.
