The petitioner alleges inaction on the part of the respondents CESC authorities in transferring the existing electricity connection at the petitioner’s premises in his name. 2. Mr. Datta learned Advocate appearing for the petitioner submits that despite an application requesting for such transfer having been made as far back as in 2024, the electricity connection has not yet been transferred in the name of the petitioner. It is submitted that the existing connection stands in the name of the father of the petitioner, who has met his demise. 3. Dr. Saharay, learned Advocate appearing for the respondents CESC authorities submits that the 2 declaration, filed by the petitioner in support of his application, is incorrect. 4. It has not been disputed by the petitioner that the declaration, filed by the petitioner in support of the petitioner’s application seeking transfer of the existing supply in his name, is discrepant. 5. In such view of the matter, no mandatory order can be passed on the present writ petition. 6. However the petitioner shall be at liberty to apply afresh for transfer of the existing supply in his name in accordance with law. 7. It is made clear that this Court has not gone into the merits of the petitioner’s claim. If any such application is made, the CESC authorities would be free to take a decision thereon, in accordance with law. 8. With the above observations and direction WPA 13675 of 2026 stands disposed of .There will be no order as to costs. 9. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Om Narayan Rai, J.)
