APP Ms. Rima Banerjee … for the State Learned senior counsel representing the petitioner submits that the case was registered in the year 2022 and the subject matter of the case relates to initial recovery of 1646 bottles of codeine. There is no recovery from the present petitioner and the present petitioner is in custody from 30.06.2025. Learned advocate appearing for the State opposes the prayer for bail and submits that earlier, his bail was rejected on 21.01.2026 as there was some antecedent of the petitioner. I have taken into account the fact that the learned advocate for the State having failed to refute the contention that there was no recovery from the present petitioner. 2 Having considered the same and the period of detention of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the present petitioner is allowed. The petitioner, namely, Sainul Sk @ Samiul Sk @ Saminur Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1072 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record.
