ORAL ORDER
Respondent No.5 is said to be the legal heir of the original grantee. The petitioners are said to be the purchasers of the granted land. At the behest of respondent No.5, respondent No.3 - the Assistant Commissioner has ordered for resumption and restoration of the land in favour of respondent No.5 under Sections 4 and 5 of the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (for short, 'the PTCL Act'). Aggrieved by the same, the petitioners have preferred an appeal before respondent No.2 - the Deputy Commissioner. The said appeal is said to be pending and it is alleged that the Deputy Commissioner has not taken up the matter for hearing.

Hence, the present writ petition is filed with the following prayers:
" a) To Direct the Respondent No.2 to consider the appeal filed by the Petitioners under section 5-A of the PTCL act in R.A (PTCL) No 52 /2026 as per ANNEXURE-L1 and also to consider the I.A for Stay filed by the Petitioner Under section as per ANNEXURE-L2. b) Issue a writ of certiorari to set aside the order dated 14.05.2026 in PTCL No.36/2023 passed by the Respondent No.3 as per ANNEXURE-H. Consequently, issue a writ of certiorari to set aside the Mutation dated 14.05.2026 vide MR-T28/2025- 26 passed by 4th Respondent as per ANNEXURE-J. c) Issue any other order or direction as this Hon'ble Court may deems fit under the
facts and circumstances of the case by allowing the above writ petition with exemplary cost in the interest of justice and equity."
2. The learned High Court Government Pleader, upon instructions, submits that the appeal of the petitioners will be
disposed of by the Deputy Commissioner in due course, in accordance with law.

It is noticed that as there is a sale deed executed in favour of the petitioners in respect of the land, which is the subject matter of the writ petition, I am of the opinion that, it would be appropriate to dispose of the writ petition by directing respondent No.2, to dispose of the appeal as expeditiously as possible and by granting protection to the petitioners in respect of the possession of the property, till such disposal. Hence, the following:
ORDER i. Respondent No.2 is directed to dispose of the appeal bearing No.R.A.(PTCL) No.52/2026, pending on his file, as expeditiously as possible, in accordance with law. ii. Till such disposal, there shall be stay of further proceedings pursuant to the
order dated 13.05.2026 passed in Case No.PTCL/36/2023 by respondent No.3 - the Assistant Commissioner vide Annexure-H to the writ petition.

iii. The Writ Petition is disposed of accordingly.
