Mr. Debasis Sur Ms. Rekha Das …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the appellant in Title Appeal No. 41 of 2023 praying for a direction upon the learned District Judge, Hooghly to dispose of the interlocutory applications in connection with the said appeal, expeditiously. Learned advocate appearing for the petitioner submits that the petitioner filed an application under Order 6 Rule 17 of the Civil Procedure Code for striking out the names of some of the respondents. He further submits that an application for stay is also pending. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge. 2 In the light of the submission made by the learned advocate appearing for the petitioner CO 2217 of 2026 stands disposed of by requesting the learned District Judge, Hooghly to make a endeavour to dispose of the pending applications as expeditiously as possible, if the same are otherwise ready for hearing. After disposal of the interlocutory applications, the learned District Judge is requested to make an endeavour to dispose of the Title Appeal No. 41 of 2023 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
