ORDER:
The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the proceedings in Ref.No. A/238/2025, dated 31.10.2025 issued by the respondent No.4 in rejecting my request for mutation of revenue records and issuance of E-pattadar pass book-cum-title deed in my favour for the land in an extent of Ac.2.11 cents in Sy. No.712, Ac.0.38 cents of Sy.No.772, Ac.0.60 cents in Sy. No.713, Ac.0.74 cents in Sy.No.719, Ac.1.07 cents in Sy.No.773, Ac.1.50 cents in Sy.No.835/2, Ac.0.87 cents in Sy.No.805, Ac.3.13½ cents in Sy.No.807, Ac.1.77½ cents in Sy.No.835/1, Ac.0.41 cents in Sy. No.708/2B and Ac.0.98½ cents in Sy.No.753 of Motakatla Village, Sambepalli Mandal, Y.S.R. District as arbitrary, illegal, contrary to the provisions of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 and also the well-established legal principles apart from being violative of the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.4 to mutate the revenue records and issue E-pattadar pass book-cum-title deed with regard to the aforesaid land and pass…”
2. The case of the petitioner is, stated briefly, as follows: a. The petitioner was a shareholder of property in the subject matter. He submitted an application for mutation of his name in the revenue records and for issuance of E-pattadar pass book -cum- title

deed in his favour. When the respondent No.2 failed to dispose of his application dated 09.09.2021, he filed W.P.No.6285 of 2022 before this High Court. The writ petition was disposed of on 11.03.2025 directing the respondent No.4 therein to consider the application within a period of six weeks from the date of receipt of the order.
b. As the respondent No.4 failed to dispose of the application as per the order in the writ petition, the petitioner filed contempt case in C.C.No.2143 of 2025. This Court ordered notice to the respondent No.4. On receipt of the notice, the respondent No.4 passed the impugned order rejecting the request of the petitioner for mutation of his name in the revenue records and issuance of pattadar pass book. c. As per Section 5(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (in short „the Act, 1971‟), no order refusing to make an amendment in accordance with the intimation shall be passed, unless, the person making such intimation has been given an opportunity of making his representation in that behalf. Since the respondent No.4 failed to follow the said procedure, the impugned proceeding of the respondent No.4 issued vide Ref.No.A/238/2025, dated 31.10.2025 is in violation of provisions of the Act, 1971 and liable to be set aside being illegal. d. The application of the petitioner for mutation was rejected on the ground that civil suit is pending. Hence, aggrieved by the action of the respondents, this writ petition was filed. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No.4 vide Ref.No.A/229/2026, dated 15.06.2026 and submitted that due to pendency of the civil disputes, the petitioner cannot file the present writ

petition, the petitioner is at liberty to prefer an appeal under Section 5(5) of the Act, 1971 before the respondent No.3. 4. In view of the above submissions, the learned counsel for the petitioner assisted by D. Dorababu, learned counsel requested to dispose of the writ petition giving liberty to the petitioner to approach the respondent No.3 to challenge the impugned order. 5. Accordingly, the writ petition is disposed of giving liberty to the petitioner to approach appropriate authority as per law to challenge the impugned order. Pending miscellaneous applications, if any, shall stand closed.
