Heard Mr. Praveen Ware, learned counsel for the petitioner as well as Mr.Shashank Thakur, learned Additional Advocate appearing for respondents No.1 and 2/State and Mr.Abhijeet Mishra, learned counsel appearing for respondent No.3. 2. The present writ petition has been filed by the petitioner with the following prayers: “10.1 That this Hon'ble Court may kindly be pleased to allow the present Writ Petition and grant appropriate relief(s) in the interest of justice. 10.2 That this Hon'ble Court may kindly be pleased to direct appropriate correction/modification of the chargsheet order dated 30.04.2025 passed in Criminal Case No. 1842/2025 arising out of FIR No. 0168/2024, in accordance with law. 10.3 That this Hon'ble Court may kindly be pleased to direct Respondent No. 1 or any independent investigating agency to conduct a free, fair and impartial further investigation in FIR No. 0168/2024 and FIR No. 0183/2024 and to submit a supplementary report within a time-bound period as may be fixed by this Hon'ble Court. 10.4 That this Hon'ble Court may kindly be pleased to direct appropriate inquiry and action in accordance with law against the concerned public officials, if any illegality. negligence, or dereliction of duty is found in the course of investigation, as may be deemed fit by this Hon'ble Court. 10.5 That this Hon'ble Court may kindly be pleased to direct Respondent No. 2 to implement, adopt, and provide structured training for the use of MedLEaPR software across the State of Chhattisgarh in a time- bound manner 10.6 That this Hon'ble Court may kindly be pleased 3 to direct Respondent No. 2 to ensure that Medico- Legal Certificates (MLCs) are prepared and maintained in a standardised manner, including issuance of copies to the hospital, Investigating Agency, and the victim, and that the victim's copy is supplied forthwith free of cost, along with digitisation of the process in a time-bound manner. 10.7 That this Hon'ble Court may kindly be pleased to issue appropriate directions to the Respondent No. 3 to ensure strict and uniform adherence by all Courts subordinate to this Hon'ble Court to the principles laid down by the Hon'ble Supreme Court in Sajjan Kumar us. CBI, (2010) 9 SCC 368, which are already binding, while dealing with matters of framing of charge and discharge. 10.8 That this Hon'ble Court may kindly be pleased to issue appropriate directions to Respondent No. 3 to ensure that judicial orders passed in criminal proceedings, particularly those involving adjudication of rights and exercise of judicial discretion, are supported by clear and reasoned findings, in accordance with the binding principles laid down by the Hon'ble Supreme Court in M/s Kranti Associates Pvt. Ltd. vs. Masood Ahmed Khan & Ors., SLP (Civil) No. 20428/2007. 10.9 That this Hon'ble Court may kindly be pleased to pass such Order or further Orders (s) as this Hon'ble Court may deem fit in the interest of justice.” 3. Learned Additional Advocate General appearing for respondents No. 1 and 2/State has drawn an attention of this Court towards the prayers made in the present writ petition and submits that the prayers are intermixed. It is further submitted that some of the reliefs sought are in the nature of a Public Interest Litigation (PIL) and, therefore, cannot be entertained in the present writ petition. 4. Learned counsel for the petitioner could not waive out the said 4 preliminary objection. 5. At this stage, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file a fresh petition seeking appropriate prayers. 6. The prayer is allowed. 7. Accordingly, the present writ petition is dismissed as withdrawn with liberty to file a fresh petition with appropriate prayers, if so advised. No order as to costs.
