Learned advocate appearing for the petitioners submits that the subject-matter of the present case relates to alleged recovery of 73 bottles of Codeine Phosphate and the petitioners’ complicity is based only on the statement of co- accused and other witnesses. Petitioner is in custody for 107 days. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that charge- sheet has been submitted, however, he is unable to refute the contentions of the petitioners that there has been no seizure from the present petitioners and their implication is only on the basis of statement of co-accused. Having considered the overall circumstances of the case, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. 2 Accordingly, the petitioners viz., 1. Anirul Mandal and 2. Hasib Sk shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 4th Court, Malda. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 1285 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
