Sri.L.Shekar., counsel for the petitioner and Smt.H.R.Renuka., counsel for the respondent have appeared in person. IN WP No.14391/2024
Smt.H.R.Renuka., counsel for the petitioner and Sri.L.Shekar., counsel for the respondent have appeared in person. 2. Counsel for the respective parties jointly submit that the parties have amicably resolved the matters and have filed a joint memo. They further submits that the memo may be placed on record and the writ petitions may be disposed of in terms of joint memo. 3. The joint memo reads as under:
"The WP filed against the award in ID.
Ref.No.18/2020 dated 16.05.2022 on the file of the Principal District & Session Judge, Chikkaballapur has been settled between the parties on the following terms and the award may kindly be modified as under:

1. The Corporation has agreed to take the petitioner into service as a fresh trainee for a period of 1 year from the date of reinstatement as per interim order. 2. The Respondent to be placed on probation for a period of 2 years on successful completion of 1 year of training. 3. The period of service rendered by the employee/trainee prior to the order of removal would not be considered for any purpose. 4. The Respondent is not entitled for the wages from the date of award till the date of reinstatement. Further, the Respondent is not entitled for the difference of pay from the date of reinstatement till the date of settlement. 5. The settlement is arrived without prejudice to the
contentions taken by the corporation that the trainee is not a workman under the provisions of ID Act and the said issue is kept open to be decided in appropriate cases.
6. The parties to the proceedings have agreed for the above terms."
4. When queried by the Court, they submit that they have taken a conscious decision to settle the matters and if an
order is passed, they shall not seek for recalling/ modification of the order.

5. The oral submission made by the counsel for the respective parties and the joint memo is placed on record.
6. The Writ Petitions are disposed of in terms of the joint memo. In view of disposal of the Writ Petitions in terms of the joint memo, the award dated:16.05.2022 passed by the Court of Principal District and Sessions Judge, Chikkaballapur is modified in terms of joint memo.
Because of disposal of the Writ Petitions, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of.
