This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.19/2026 registered at Police Station – Out Post Khadgawan, Police Station Pratappur, District Surajpur (C.G.) for GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.03.03 16:58:54 +0530 2 the offences punishable under Sections 305 (B), 331(3), 111(1), 316(4) Read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (Offence mentioned as per Case Diary, which was received by the concerned Court while deciding the bail application). 2. Case of the prosecution, in brief, is that the FIR was lodged by the complainant namely Uday Pratap Choudhari, who was working as a Manager (Mining) at Jangannathpur Open Cast, Bhatgaon alleging inter-alia that on 15-01-2026, the truck tralla bearing Registration Number CG-10/BL-9694 was authorizely permitted to enter in the Mines area and the said truck was not weighted inside the Mines area and the coal was directly loaded in the truck i.e. about 40 Tons amounting to Rs.1,90,000/- was stolen. On the basis of said report lodged by complainant Uday Pratap Choudhari, the Police registered the offence against the driver of truck tralla bearing Registration Number CG-10/DL-9649 and during the course of investigation, the police arrested the co- accused person and the name of present applicant has been mentioned by the co-accused Madan Singh in his memorandum statement. On the basis of memorandum statement of the co- accused, in which the name of present applicant appears, the present applicant is apprehending his arrest. 3. Learned counsel for the applicant submits that the applicant is the employee of the SECL and three of the co-accused have been arrested and they filed regular bail application and the same was 3 posted after four weeks as charge sheet was not submitted. He would submit that so far as the applicant is concerned, he has already been suspended from the service and he has given his explanation. He would submit that the applicant is permanent resident of address shown in the cause title, there is no chance of his absconding and applicant is ready to furnish adequate surety and shall abide by all the directions and conditions, which may be imposed by this Court, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the fact that the applicant has already been suspended from service and he has come up before this court for grant of anticipatory bail and further considering the fact that investigation and trial are likely to take some time, without further commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Jagdamba Singh, on executing a personal bond and one surety in the like sum to the 4 satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
