Affidavit of service filed in Court today is taken on record. 2. The writ petitioner alleges inaction on the part of the respondent electricity authorities in granting electricity supply to the petitioner’s residential premises. 3. Mr. Halder, learned Advocate appearing for the petitioner submits that an application for fresh electricity connection had been made as far back as on June 16, 2025 and the same still remains pending despite the petitioner having deposited the amount quoted by the respondent CESC Authorities for the purpose of effecting electricity connection. 4. Mr. Mukherjee, learned Advocate appearing for the CESC Limited submits that the electricity supply could not be effected to the petitioner’s premises for two reasons. It is submitted that firstly, the petitioner has not constructed the meter board shed which is a prerequisite in the present case. He 2 submits that the next reason for the inability to provide electricity supply despite requests is the resistance put up by the private respondents. 5. The private respondent nos. 4 to 7 are represented through Mr. Pathak, learned Advocate. 6. Mr. Pathak submits that the private respondents have no objection, in principle, in the petitioner getting electricity supply. However, the private respondents have also made application for fresh electricity connection in their names which remains pending and should be disposed of by the electricity authorities. 7. Having heard the learned Advocates appearing for the respective parties and having considered the material-on-record, this writ petition is disposed of by directing the respondent no.2 herein i.e. the District engineer, CESC Limited, South West Regional Office to supply electricity to the petitioner within a period of four weeks from the date of the petitioner constructing the meter shed and complying with all other formalities that may be required for the purpose of grant of electricity connection at the said premises in accordance with law. 8. Although the private respondents are represented and have submitted before this Court through Mr. Pathak that they have no objection, yet, if any 3 objection is raised or resistance is put up impeding the works undertaken by the CESC Authorities for effecting electricity connection in the name of the petitioner, the CESC Authorities shall be free to take assistance of the jurisdictional police. 9. The Officer-in-Charge, Nadial Police Station is requested to provide necessary police assistance to the respondent CESC authorities in case the said Officer-in-Charge is approached by the CESC Authorities. The costs for police assistance will be borne by the petitioner. 10. The private respondents are at liberty to pursue their applications for electricity connection that they have made before the CESC Authorities, in accordance with law. 11. With the aforesaid observations, WPA 14456 of 2026 stands disposed of. There shall be no order as to costs. 12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
