1. The writ petition has been filed complaining illegal construction at the behest of the respondent Nos. 6 and 7 in respect of the premises/holding No. 27, Hat Lane, ward No. 29, Howrah and the failure on the part of the municipal authorities to take steps.

Having heard the learned advocates and noting that on the basis of the inspection carried out by the municipality since it was detected that two additional floors had been constructed and stop work notice had already been issued, the municipality was directed to file a report. It was further provided for in the order dated 20th May, 2026 that since the building is under construction, the building should not be permitted to be occupied till the next date of hearing. Pursuant to the aforesaid direction, the municipality has produced bunch of records, inter alia, including the stop work notice, the show cause notice dated 2nd February, 2024, the notice of hearing along with the self-demolition order

dated 28th March, 2024 issued under the provisions of Section 177 of the HMC Act.
3. From the aforesaid self-demolition order, it would transpire that the person responsible had carried out an unauthorized construction of two additional floors over a G+2 storied building. Though the order is dated 21st March, 2024, the municipality is yet to take any steps in this regard.
4. In the peculiar facts as hereinabove, I direct the municipal authorities to forthwith implement its order in accordance with law. The jurisdictional Police Station is directed to render assistance to the municipal authorities on requisition.
5. Since nothing survives in the writ petition, the same is accordingly disposed of.
