Das Mr. Praloy Bhattacharjee … for the NCB Learned advocate for the petitioner submits that inspite of the earlier directions, till date, the evidence of the seven witnesses have been completed and three more witnesses are left to be examined. The petitioner is in custody for two years eight months, as such, learned advocate prays that the petitioner may be released on bail on any stringent condition. Learned advocate for the NCB opposes the prayer for bail and draws the attention of the court to the fact that on the basis of production warrant, the petitioner was produced in connection with the instant case. Additionally, it is submitted the petitioner is already an accused in connection with Lalgola PS Case No. 578 of 2021. 2 Having considered the previous antecedents of the present petitioner in respect of the similar offences, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. The learned Special Court would expedite the process of trial by completing the evidence of rest of the witnesses within a reasonable period of time. Accordingly, CRM (NDPS) 1025 of 2026 is dismissed. Report submitted be kept with the record.
