The present bail application has been filed under Section 482 BNSS in connection with FIR No. 372/2025 registered at Police Station Kherthal District Kherthal-Tijara for the offence(s) under Sections 115(2), 128(2), 189(2) of BNS, 2023. 2. Learned counsel for the accused-applicants has submitted that present is a case wherein cross FIRs have been registered and that there are no criminal antecedents registered against the applicants. It is submitted that main accused in the present matter is Anish Khan upon whom the main allegations have been levelled. It is further submitted that interim order dated 09.02.2026 was passed by the Co-ordinate Bench of this Court in [2026:RJ-JP:11132] (2 of 3) [CRLMB-2352/2026] favor of the applicants, subject to joining the investigation and the learned counsel for the applicants undertakes that the applicants have joined the investigation, as and when directed. 3. Per contra, learned Public Prosecutor as well as counsel for the complainant have vehemently opposed the instant bail application but not able to refute the above-said contentions made by learned counsel for the applicants. 4. Having heard the contentions advanced by the learned counsel of the parties, upon a perusal of the material available on record, taking note of the fact that present is the case wherein cross FIRs have been registered; that there are no criminal antecedents registered against the applicants; that the main allegations have been attributed to the co-accused, namely Anish Khan, and considering the interim order dated 09.02.2026 and undertaking given by the learned counsel for the applicants that applicants have joined the investigation, this Court is inclined to make the order dated 09.02.2026 as absolute and allow the instant bail application. 5. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Kherthal, District Kherthal-Tijara in F.I.R. No. 372/2025 is directed that in the event of arrest of the accused-applicants Wasim S/o Aasmohammed & Sakrulla S/o Deen Mohammed, they shall be released on bail, provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station. Withal, following conditions are also imposed upon the applicants:- [2026:RJ-JP:11132] (3 of 3) [CRLMB-2352/2026] (i) that the applicants shall make themselves available for interrogation by a police officer as and when required; (ii) that the applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the applicants shall not leave India without previous permission of the court.
