It is submitted that one of the accused persons, namely, Suresh Chandra Acharya, a deed writer has been allowed to go on bail pursuant to the Court’s
order in ABLAPL No.474 of 2026. A copy of the said order dated 27th January, 2026 is produced at the time of hearing, which is also at Flag-A. One of the petitioners, namely, K. Amojiamma Dora, who is one of the legal heirs of the deceased, executed the sale deed, whereas, the other accused, namely, Bhagyalata Mohapatra happens to be the purchaser. Since the sale has been effected in the name of a dead person, the report was lodged by the Sub-Registrar. It is claimed that the petitioners have no similar antecedents. Considering the fact that one of the LRs is involved with the purchaser of the land is entangled, this Court, recording the submissions of learned counsels of both the sides, is of the view that though they are not entitled to pre-arrest bail, but should be directed to surrender before the learned court below for being released with suitable conditions imposed.
