Mr. Uday Sankar Bhattacharya Ms. Sretapa Sinha. …for the Union of India/Customs Authority. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 10 months. There has been alleged recovery of 1.997 kgs. of ganja. Complaint has already been submitted before the jurisdictional court, as such, the petitioner may be released on bail. Learned advocate for the Air Customs opposes the prayer for bail. Having considered the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) 2 No.3641 of 2026) wherein emphasis was laid on intermediate quantity, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Shahzada Hussain shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, 8th Court (Special Court under NDPS Act), Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, the petitioner shall make himself available as and when called for by the investigating officer of the case or any officer deputed by the Principal Commissioner, Air Customs till further orders of this Court. Accordingly, CRM(NDPS) 1292 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
