The petitioner is aggrieved by the pendency of its application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereafter as the said SARFAESI Act, 2002). 3. The petitioner claims to be secured creditor under the SARFAESI Act, 2002. 4. Learned advocate appearing for the petitioner submits that an application under Section 14 of the 2002 Act was made by the petitioner on December 03, 2024 before the District Magistrate South 24 Parganas and the same still remains pending. 5. Learned advocate appearing for the State respondent submits that the hearing before the 2 District Magistrate has been scheduled today itself. A write up in such regard prepared by the officer in charge SARFAESI Section, South 24 Parganas on July 09, 2026 has also been handed up to Court in such regard. The same is taken on record. 6. Since it is apparent from the said report that the matter is scheduled to be heard today itself by the District Magistrate, this writ petition is disposed of by directing the District Magistrate, South 24 Pargans to dispose of the petitioner’s application under Section 14 of the SARFAESI Act, 2002 in accordance with law, expeditiously and preferably within a period of four weeks from date. 7. With the above observations, WPA 14735 of 2026 stands disposed of. There shall be no order as to costs. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
