This Writ Petition has been filed seeking direction to respondents authorities to act upon the rehabilitation list (Annexure P/1) of shops to persons whose AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.07.23 18:12:50 +0530 2 shops were demolished on the National Highway Bemetara. 2. Learned counsel for the petitioner submits that petitioner was running a shop near National Highway Kawardha Road, Bemetara, which was disposed by respondents on assurance of allotment of new shop. She submits that for the said purpose a rehabilitation list (Annexure P/1) was prepared, in which, name of the petitioner finds it place at Serial No.93 for allotment of shop, however, till date nothing has been done. She submits that in this respect, petitioner has already filed various representations viz on 03.01.2022 before the authorities but the same have not been decided, as such, appropriate direction may be issued to the authorities to decide the representation of the petitioner. 3. Learned State counsel submits that if the petitioner has moved appropriate application in this regard, it will be decided in accordance with law. 4. Having heard learned counsel for the parties and upon perusal of the documents, it appears that a rehabilitation list (Annexure P/1) has been prepared by Respondent No.5 in which name of the petitioner is mentioned in Serial No.93, as such, the petitioner moved an application dated 03.01.2022 before the authorities for appropriate relief contending that his name is mentioned at Serial No.93, which has not been decided by the authorities, therefore, this Writ Petition is disposed of with a direction to petitioner to move a fresh application in this regard before the concerned authorities i.e. Respondent No.5 who is also directed to consider and decide the said application in accordance with law, in an expeditious manner, preferably within a period of 45 days from the date of receipt of copy of this order. 5. It is made clear that this Court has not expressed any opinion on the merits 3 of the case and the concerned authority is at liberty to pass appropriate order on its own merits.
