The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit No. 20 of 2026 from the Court of the learned Additional District & Sessions Judge, Amta, Howrah to the Court of the learned Additional District Judge, Barrackpore, North 24 Parganas. 2. It is the case of the petitioner/wife that she is residing with her minor child at Premises No. 30/3, Nayapatty Road, C-3, 3rd Floor, Bangur Avenue, P.O. Bangur, P.S. Nagerbazar, Dum Dum, Kolkata-700 055. 3. On the other hand the husband/opposite party is residing at Vill-Bhawanipur, P.O. Chitrasenpur, P.S. Udaynarayanpur, District-Howrah, Pin- 711412. 4. Considering the said difficulty of the petitioner/wife having a minor child, to travel to 2 Howrah on regular basis, this Court relying upon the judgments of the Hon’ble Supreme Court in N.C.V. Aishwarya vs A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), directs that Matrimonial Suit no. 20 of 2026 be withdrawn from the Court of the learned Additional District & Sessions Judge, Amta, Howrah and be transferred to the Court of the learned Additional District Judge, Barrackpore, North 24 Parganas. 5. The Learned Additional District Judge, Barrackpore, North 24 Parganas, shall proceed with the suit in accordance with law with due notice upon both the parties. 6. Keeping in mind the case of the petitioner herein, the learned Additional District Judge, Barrackpore, North 24 Parganas, shall be at liberty to permit the parties to appear virtually, if such prayer is made. 7. CO 1387 of 2026 is also disposed of. 8. Parties to act on the server copy of this order. 9. Let a copy of this order be sent to the concerned Courts for immediate compliance. (Shampa Dutt (Paul), J.)
