Mr. Anirban Roy Mr. Debjit Basu ….for the petitioner The learned advocate appearing for the petitioner submits that on the ground of pendency of an application under Order VII Rule 11 of the Code of Civil Procedure, the injunction application filed by the petitioner is not being taken up for hearing. He submits that September 15, 2026 has been fixed for hearing of the application under Order VII Rule 11 of the Code of Civil Procedure. The learned advocate appearing for the petitioner submits that the learned trial judge be directed to take up the hearing of the application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure on that date itself. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this civil revisional application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. CO 2203 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 2nd Court at Serampore, District-Hooghly to take up the hearing of the application under Order VII Rule 11 of the Code of Civil Procedure on 2 the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. It will be open to the petitioner to approach the learned trial judge for fixing a date of hearing of the injunction application. If such prayer is made, the learned trial judge shall consider the same and pass orders accordingly. There will be no order as to costs.
