Learned advocate appearing for the petitioner draws the attention of the order passed in CRM(NDPS)1263 of 2026 and submits that the petitioner is similarly situated as the other accused who has been granted bail. Learned advocate for the State opposes the prayer for bail and submits that the quantum of recovery is of commercial quantity. I have taken into account the period of detention of the present petitioner, the quantum of recovery of codeine phosphate and that another accused has been granted bail and there are no antecedents reflected from the memo of evidence. Having considered the overall circumstances, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. The 2 petitioner, namely, Kamal Sekh @ Kalam shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without the prior permission of the learned special court. Thus, CRM(NDPS) 1116 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
