Learned advocate appearing for the petitioners submits that the petitioners are better placed than the other accused person, namely, Lalchand Mia @ Lalchand who has been granted bail in CRM(NDPS)1263 of 2026. Petitioners are in custody for more than 4 months and charge-sheet has already been submitted. Learned advocate appearing for the State opposes the prayer for bail but is unable to controvert the statement that there has been no recovery from the present petitioners. Having regard to the factual circumstances of the case, petitioners, namely, Md. Jenarul Sk. and Md. Misbauddin Sk. are directed to be released on bail by the learned special court on same terms and conditions as was imposed upon Lalchand Mia @ 2 Lalchand in CRM(NDPS)1263 of 2026. Thus, CRM(NDPS) 1296 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
