Mr. Souadipta Banerjee Ms. Shamrin Mr. Ranojoy Mullick ….for the petitioner Affidavit of service filed in Court today is taken on record. Mr. Banerjee, learned advocate appearing for the petitioner submits that the petitioner is not being able to enjoy the fruits of the eviction decree passed on June 19, 2018. He submits that the opposite parties are unnecessarily delaying the hearing of the Misc. Case No.35 of 2019. He further submits that in spite of an undertaking being given by the opposite parties before the Hon’ble Supreme Court, the opposite parties have not yet vacated the premises. After going through the order sheets appended to this application, this Court finds that July 7, 2026 was fixed for evidence of OPW and in default for argument. Mr. Banerjee, learned advocate appearing for the petitioner submits that evidence of OPW have already been completed and July 28, 2026 has been fixed for arguments. Mr. Banerjee draws the attention of the Court to an earlier order dated September 11, 2025 passed in C.O. 3342 of 2025, requesting the learned Executing Court to 2 dispose of the miscellaneous case within a period of four months. In view thereof, CO 2070 of 2026 stands disposed of by requesting the learned Judge, 4th Bench, Presidency Small Causes Court at Calcutta to take up the miscellaneous case for argument i.e. on July 28, 2026 and to dispose of the same as well as the execution case as expeditiously as possible but preferably by the end of the month of August, 2026 without granting any unnecessary adjournments to either of the parties.
