This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 82/2026 registered at Police Station – Newai, District – Durg (C.G.), for the offence punishable under Sections 109 of the Bhartiya Nyaya Sanhita, 2023. 2. The case of the prosecution is that on 15.02.2026, at about 5:30 P.M., inside a lane near Indira Chowk, Station Maroda, the present applicant allegedly attacked the complainant, Chandrakal Narang, on her neck with a thermocol cutter. When the complainant attempted to defend herself, she sustained an injury to her right wrist. Thereafter, the present ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.07.23 15:04:07 +0530 2 applicant allegedly attacked the complainant for a second time with the same cutter, causing an injury to her cheek. It is further alleged that when the applicant attempted to attack the complainant for the third time, she fell down. Consequently, on 15.02.2026, an offence under Section 109 of the Bharatiya Nyaya Sanhita, 2023, was registered against the present applicant, and after completion of the investigation, the charge-sheet has been filed. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that the injuries sustained by the complainant are simple in nature. He also submits that only a general allegation has been made against the present applicant that he assaulted the injured. He further submits that the applicant has been in jail since 16.02.2026, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant, with the intention of causing the death of the complainant, repeatedly assaulted her with a thermocol cutter, inflicting injuries on her wrist, cheek, neck, and ribs. During the course of the investigation, the weapon of offence was recovered at the instance of the applicant pursuant to his memorandum statement. He further submits that the applicant has three criminal antecedents under the Arms Act, the Gambling Act, and the Bharatiya Nyaya Sanhita, 2023. Therefore, considering the nature and gravity of the allegations, the applicant is not entitled to the grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, particularly the 3 nature and gravity of the allegations that the applicant repeatedly assaulted the complainant with a thermocol cutter with the intention of causing her death, resulting in multiple injuries on vital parts of her body, the recovery of the weapon of offence at the instance of the applicant pursuant to his memorandum statement, and further considering that the applicant has three criminal antecedents under the Arms Act, the Gambling Act, and the Bharatiya Nyaya Sanhita, 2023, this Court is not inclined to grant regular bail to the applicant. 7. Accordingly, the first bail application of the applicant – Yogendra Kumar Yadav Urf Toilet, involved in Crime No. 82/2026 registered at Police Station – Newai, District – Durg (C.G.), for the offence punishable under Sections 109 of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
