Present is a writ petition filed by the petitioners under Article 227 of the 3 Constitution of India against the impugned order dated 19.06.2025 passed by Chhattisgarh Board of Revenue, Bilaspur in case No. RN/02/R/A-06/22/2025 whereby the revision filed by the petitioners as well as respondents No. 3 and 4 has been dismissed. 3. Learned counsel for petitioners would submit that pursuant to the order dated 16.12.2014 passed by the Co-ordinate Bench of this Court in Writ Petition No.1022/2002 and mutation proceeding was initiated by the Tehsildar, Bilaspur for mutation of the name of the Bhupendra Singh (deceased respondent No.1), thereafter, the Tehsildar has passed an order on 23.03.2015 directing for mutation of the name of deceased respondent No.1 Bhupendra Singh over the land of 0.75 Acre of Khasra No. 205/15 situated at village – Uslapur, Patwari Halka No. - 45, Tehsil – Takhatpur, District – Bilaspur and 0.25 Acre land of the said Khasra number in the name of Rajesh Kumar. The objector Prabhudayal Khandelwal filed the appeal against the order dated 23.03.2015 passed by the Tehsildar before the SDO(Revenue), Kota. In the appeal filed by the objector, a compromise was taken place between the objector and deceased respondent No.1 Bhupendra Singh and on the basis of said compromise, the appeal filed by the objector was disposed of vide order dated 02.02.2016. Against that order dated 02.02.2016, the deceased respondent No.1 Bhupendra Singh filed a Second Appeal before the Commissioner, Bilaspur Division. The said Second Appeal was allowed by the Commissioner, Bilaspur Division vide order dated 27.12.2024 and the order passed by the SDO(Revenue), Kota was set aside. During pendency of the Second Appeal before the Commissioner, Bilaspur Division, the objector 4 Prabhudayal Khandelwal had expired and his legal heirs were brought on record. The legal heirs of the Prabhudayal Khandelwal had challenged the order dated 27.12.2024 passed by the Commissioner, Bilaspur Division before the Chhattisgarh Board of Revenue by filing their revision. The said revision filed by the legal heirs of the objectors has been dismissed by the Board of Revenue vide order dated 19.06.2025 which is under challenge in the present writ petition. 4. Learned counsel for the petitioner would further submit that during pendency of the present writ petition, the present respondent No.1 Bhupendra Singh has been died and his legal heirs have been substituted in the present writ petition. Where the parties have entered into a compromise with respect to the subject property and deed of the compromise was executed on 02.06.2026 and without going into merits of the case, the present writ petition may be disposed of in the terms of the compromise arrived at between the parties, copy of the deed of compromise dated 02.06.2025 has also been annexed by the petitioner on 15.06.2026 alongwith an application for issuance of appropriate directions supported by an affidavit of petitioner No.1 Seema Khandelwal. He would further submit that the petitioner No.2 has also filed her affidavit in support of the compromise on her own behalf and on behalf of petitioner No.4 who is her minor daughter. He would also submit that petitioner No.3 also filed her affidavit in support of the compromise arrived at between the parties on 20.07.2026, and therefore, since the parties have already settled their dispute, the present writ petition may be disposed of in the terms of the compromise. 5 5. On the other hand, learned counsel for the respondent No.1(A) and (B) have not disputed the terms of compromise and he too is willing to dispose of the present writ petition in terms of the compromise arrived at between the parties and he would also submit that the legal heirs of Bhupendra Singh would not pursue the order passed by the Commissioner, Bilaspur Division and they will act upon the compromise arrived at between the parties in its terms. 6. I have heard learned counsel for the parties and perused the material annexed with the writ petition. 7. Since the parties have entered into compromise and executed a deed of compromise on 02.06.2026 and both of them willing to dispose of the present writ petition under the terms of compromise, it would Accordingly, in view of the compromise arrived at between the parties, as evidenced by the Deed of Compromise dated 02.06.2026, and the affidavits filed by the respective parties supporting the same, and since learned counsel appearing for the parties have jointly submitted that the dispute has been amicably resolved and have prayed for disposal of the present writ petition in terms thereof, without entering into the merits of the controversy involved in the case, the present writ petition stands disposed of in terms of the compromise arrived at between the parties. 8 9. The parties shall remain bound by the terms and conditions of the said compromise and shall act in accordance therewith. It is, however, made clear that this Court has not expressed any opinion on the merits of the claims of either party. It is further observed that in the event any dispute arises in relation to the implementation or enforcement of the terms of the compromise, or if any occasion so arises in future, it shall be open to the respective parties to avail such remedy as may be available to them in accordance with law before the appropriate forum. 10.
