From the order sheets appended to this application, this Court finds that the Misc. Case No. 85 of 2025 filed under the provisions of Section 47 of the Code of Civil Procedure is pending. The learned advocate appearing for the petitioner submits that 5th September, 2026 has been fixed for hearing of the Misc. Case No. 85 of 2025. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite parties forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), 5th Court at Alipore to take up the hearing of the Misc. Case No. 85 of 2025 on the next date fixed, if the same is otherwise ready for hearing and make all endeavour to dispose of the same as early as possible without grating any unnecessary adjournments to either of the parties. After disposal of the aforesaid Misc. Case and any other misc. case that may be pending, the learned Executing Court is requested to dispose of the Title Execution Case No. 19 of 2022 as expeditiously as possible, without granting any unnecessary adjournments to either of the parties.
