The civil revision has been preferred by the petitioner/wife of the opposite party no.3 praying for transfer of Money Suit No. 89 of 2023 pending before the Learned Civil Judge (Sr. Division), 1st Court at Asansol, Paschim Bardhaman to the Court of the Learned Civil Judge (Sr. Division), Paschim Medinipur. 2. It is the contention of the petitioner/wife that the suit is a suit for defamation and even though both the petitioners and the opposite parties are residents of Paschim Mediniour, the opposite party has filed the suit at Paschim Bardhaman. 3. Learned counsel for the opposite parties submits that they were compelled to file the suit at Paschim Bardhaman as the petitioners and their men and agents are troubling the opposite parties. 4. On hearing the learned counsels for the parties, it appears that there is a matrimonial dispute between the parties and admittedly the parties are residents of Paschim Medinipur and another case pending at Paschim Medinipur. 5. Considering the fact that both parties are permanent residents of Paschim Medinipur and there is no materials on record to prima facie show that there is any prima facie threat to the opposite parties herein, the civil revision is allowed. 6. Money Suit No. 89 of 2023 be withdrawn from the Court of the Learned Civil Judge (Sr. Division), 1st Court at Asansol, Paschim Bardhaman and be transferred to the Learned Civil Judge (Sr. Division), Paschim Medinipur. 7. Learned Civil Judge (Sr. Division), Paschim Medinipur shall proceed with the suit in accordance with law upon due notice to both the parties. 8. CO 1474 of 2024 stands disposed of. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on urgent basis after completion of all necessary formalities. ( Shampa Dutt (Paul), J.) 2
