Order No.
ORDER 27.07.2026
03.
1. Since all the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together and are disposed of by this common order.
2. Heard learned counsel for the Petitioners and
learned counsel for the State. p. 2
3. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.427 of 2026 pending on the file of learned J.M.F.C.-IV. Bhubaneswar, arising out of Laxmisagar P.S. Case No.211 of 2026 for commission of offences punishable under Sections 126(2)/115(2)/109/296/351(2)/351(3)/3(5) of BNS read with Section 25(1)(a) of Arms Act.
4.
Learned counsel for the Petitioners submits that exaggerated allegations have been made. Hence, the Petitioners may be protected by pre-arrest bail.
5.
Learned counsel for the State opposes the prayer for pre-arrest bail, inter alia, on the ground that the Petitioner in ABLAPL No.6487 of 2026 has series of criminal antecedents having been cited as an accused in 15 cases.
6. Perused the injury report indicating that the injured has suffered simple injury.
7. Considering the nature of allegation and the
submissions made, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner in ABLAPL No.8353 of 2026 shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.
8. If it comes to the fore that the Petitioner in ABLAPL No.8353 of 2026 has any such criminal antecedent, this order shall not be given effect to. p. 3
9. It is needless to state that the Petitioner in ABLAPL No.8353 of 2026 shall cooperate with the ongoing investigation.
10. So far as the Petitioner in ABLAPL No.6487 of 2026 are concerned, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner in ABLAPL No.6487 of 2026 surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.
11. Accordingly, the ABLAPL stands disposed of.
12. U.C.C. as per rules.
