At the very outset, learned counsel for the petitioner does not want to press the present petition on merits. The limited prayer made by him is that in the event of an application is filed by the petitioner before the concerned authority, it be directed to decide the same in the light of the judgment passed by the Co- ordinate Bench of this Court at Principal Seat, Jodhpur in the case of Rajpal Vs. The State of Rajasthan & Ors. (SB Criminal Writ No.87/2016). 2. Learned Deputy Government Advocate does not oppose the same. 3. Taking into consideration the facts and circumstances of the case, it is directed that if the petitioner files a fresh application before the concerned authority, same shall be decided in accordance with law and in the light of the judgment passed by [2026:RJ-JP:8908] (2 of 2) [CRLMP-7683/2025] the Co-ordinate Bench of this Court in the case of Rajpal (supra) mutatis mutandis. 4.
