Keshri, A.P.P. ------ 03/ 01.04.2026 Heard learned counsel appearing for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Garhwa P.S. Case No. 478 of 2025, registered for the offence under Sections 103(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned C.J.M., Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and his name has come in course of investigation. He next submits that only allegation is made against this petitioner of hatching the plan to commit crime. 4. Learned A.P.P. appearing for State has opposed the prayer and submits that the petitioner happened to be the planner of committing murder of the deceased. 5. Considering that the name of the petitioner has come on the basis of confessional statement of apprehended co-accused and it has come in the case diary as well as in the order of the learned Sessions Judge that this petitioner has got the plan of committing murder of the deceased and in the attending facts and circumstances of the case, I am not inclined to provide the privilege of anticipatory bail to the petitioner.
