IN THE HIGH COURT OF ORISSA AT CUTTACK
ABLAPL No.218 of 2026
Tuna @ Hruteswar Pradhan
…. Petitioner Mr. A.K. Sahoo, Advocate
-Versus-
State of Odisha …. Opposite Party
Ms. S. Nayak, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 13.01.2026
01.
1. Heard Mr. Sahoo, learned counsel for the petitioner and Ms. Nayak, learned ASC for the State.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Kundheigola P.S. Case No.164 of 2025 corresponding to C.T. Case No.335 of 2025 pending in the file of learned J.M.F.C., Reamal on the grounds stated therein.
3. Upon perusal of the FIR at Annexure-1, this Court finds that the items mentioned therein were stolen by some culprits and accordingly, a case was registered under Section 303(2) BNS. It is submitted to the Court by Mr. Sahoo, learned counsel for the petitioner that all the accused persons arrested in connection with the incident have been granted bail. The further submission is that after the arrest of one of them,
namely, Abhi @ Abhimanyu Naik, the involvement of the petitioner was revealed by him. The contention is that solely on the basis of confessional statement of the co-accused named above, the petitioner has been implicated, who is having no similar antecedent.
4. Recorded the objection of the State.
5. The forwarding reports in respect of the accused persons are produced before this Court by the learned counsel for the petitioner and the same are gone through. In fact, three of them were arrested and forward on 6th August, 2025 and they did not reveal anything about the involvement of the petitioner, whereas, the other accused namely, Abhi @ Abhimanyu Naik arrested later and forwarded on 19th September, 2025 disclosed such his involvement. Considering the above facts and the absence of any direct evidence showing involvement of the petitioner, who apparently named by one of the co-accused and recording the submissions of the learned counsel for the respective parties, this Court though not inclined to grant pre- arrest bail, however, is of the view that the petitioner should be
directed to be released on bail upon his surrender before the court concerned with suitable conditions.
6. Accordingly, it is ordered.
7. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C., Reamal within a fortnight from today, he shall be released on bail in connection with Kundheigola P.S. Case No.164 of 2025
corresponding to C.T. Case No.335 of 2025 subject to him furnishing a bail bond of Rs.30,000/- (Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the
facts and circumstances of the case.
8. Issue urgent certified copy as per rules.
