Learned counsel for the petitioner submits that the petitioner is in custody in connection with Simariya P.S. Case No. 193/2023 for the offence registered under Section 376 of IPC and Section 4 of POCSO Act, now said to have been pending in the court of learned Additional Sessions Judge-cum-Special Judge POCSO Act, Chatra as POCSO Case No. 10/2024. 2. The learned counsel for the petitioner has submitted that the petitioner is in custody since 29.10.2023 and the allegation against the petitioner is that he has raped minor daughter of the informant. The learned counsel submits that the bail application of the petitioner was earlier rejected twice by this Court in B.A. No. 1559 of 2024 vide order dated 08.04.2024 and again in B.A. No. 6406/2024 vide order dated 09.12.2024. The learned counsel submits that the next date before the learned trial court is 17.04.2026. 3. Learned counsel for the State has opposed the prayer and has submitted that the trial is in advance stage. 4. After hearing the learned counsel for the parties and considering the serious nature of offence and also the fact that as per impugned order dated 15.01.2026, out of 7 charge-sheeted witnesses, six witnesses have 2026:JHHC:9563 2 been examined and the trial is in advance stage, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is rejected. 5. However, the State is directed to ensure prompt production of the sole remaining witness to be examined before the court. 6. Learned counsel for the State is directed to communicate a copy of this order to the Director, Prosecution as well as Superintendent of Police of the concerned district to ensure compliance. 7.
