2 appearing for the State/respondent No.1, is present. 2. The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for following relief:-
“It is therefore, prayed that this Hon'ble Court may kindly allowed this petition and quash the FIR registered before police station- Tarbahar, Distt- Bilaspur (C.G.) in crime no. 239/2022, as well as charge sheet no. 94/2024 filled on dated 11.03.2024 and the entire criminal proceeding pending before learned Judicial Magistrate First Class, Bilaspur, Distt- Bilaspur (C.G.) in criminal case no 1387/2024 and the cognizance dated 11.03.2024 taken by the learned trial court e, in the interest of Justice.”
3. From a perusal of the prayer clause contained in the present petition, it appears that the same is fundamentally defective. Though the petitioner seeks quashment of FIR No.239/2022 registered at Police Station Tarbahar, District Bilaspur, Charge-sheet No.94/2024 dated 11.03.2024, the order taking cognizance dated 11.03.2024 and the consequential criminal proceedings pending in Criminal Case No.1387/2024, the petitioner has failed to even mention the offences for which the charge-sheet has been filed. Further, this Court cannot lose sight of the fact that the petitioner has invoked the extraordinary jurisdiction of this Court without laying any challenge to the order framing charges, which constitutes the foundational grievance sought to be agitated. Such a casual and sketchy
3 approach reflects lack of due diligence and has resulted in unnecessary consumption of the valuable judicial time of this Court. 4. In view of the aforesaid glaring defects, this Court is of the opinion that the present petition deserves to be dismissed on this ground alone. However, liberty is reserved in favour of the petitioner to file a fresh petition, if so advised, after curing all the defects and laying an appropriate challenge to the relevant orders, in accordance with law. 5. Consequently, while granting the aforesaid liberty, this Court deems it appropriate to impose costs quantified at Rs.2,000/- (Rupees Two Thousand only) upon the petitioner. The said amount shall be deposited before the Registry of this Court within a period of two weeks from today.
Upon such deposit, the Registry shall transmit the said amount to the Government Special School for Intellectually Retarded Girls, Gangapur, Ambikapur, District Surguja, Chhattisgarh, for the welfare of its students. 6. The certified copies of the annexures, if any, be returned to the
