JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court seeking the following prayers: "WHEREFORE, the petitioners most respectfully prays that this Hon'ble court be pleased to allow this petition and quash the entire proceedings initiated against the above petitioners no.1 to 7/accused no.1 to 7 arising out of impugned Charge sheet in CC No. 193/2025 (Crime No.160/2025) registered with the Tumakuru women's police station, Tumakuru for an alleged offence - 3 - HC-KAR NC: 2026:KHC:35881 CRL.P No. 2934 of 2026 punishable under 85, 115(2), 351(2), 352, r/w 3 (5) of BNSS and Section 3 of Dowry Prohibition Act 1961, which is pending on the file of IInd Addl. Senior Civil Judge and JMFC, Tumakuru in the interest of justice." 2. Heard Sri.Mohammed Ummar Farooq, learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Vaseemuddin A, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with affidavit. The compounding application reads as follows: "1 The Complainant and Accused jointly submit as follows: That the petitioner and respondent No.2 with the advise of elders and well wishers both have agreed to compromise. 2 The Complainant and Accused submits that there is no other case pending against Petitioner/Accused. The Complainant undertakes to close the issue by way of compromise. 3 There is no coercion or threat from any other person. The settlement is voluntary. On the advice of elders and well wishers of both the parties the Complainant/Respondent No.2 and accused/Petitioner have agreed to settle the issue. If the permission is granted by this Hon'ble Court both the parties are ready and willing to settle the issue by compounding the same. - 4 - HC-KAR NC: 2026:KHC:35881 CRL.P No. 2934 of 2026 4 There is no coercion or threat from any other person. The settlement is voluntary. On the advice of elders and well-wishers of both the parties the Respondent No.2 and Petitioners have agreed to settle the issue and also Respondent No. 2 Received Alimony of Rs.50,000/- and all Gold ornaments with other Belongings. WHEREFORE the Petitioners and Respondent No.2 prays that this Hon'ble court may be pleased to: a) Permit the Petitioners and Respondent No.2 to compound the offence punishable under section 498-A, 323, 504 read with 34 IPC and Section 3 and 4 Dowry Prohibition Act, 1961 registered by the Respondent Police in C.C.NO.269/2025 pending on the file of the learned III Additional Civil Judge and JMFC at Tumkuru. b) To close the case as settled out-of-court and discharge the accused/Petitioners from all charges in C.C.NO.269/2025 for the offence punishable under section 498-A, 323, 504, of IPC and Section 3 and 4 Dowry Prohibition Act, 1961 registered by the Respondent Police in the interest of justice and equity." 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. - 5 - HC-KAR NC: 2026:KHC:35881 CRL.P No. 2934 of 2026 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.269/2025 pending before the III Addl.
