Sri Mantu Das Mr. Arjun Samanta Mr. Samudraneel Nandi …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court at Sealdah to dispose of Title Suit No. 312 of 2021 expeditiously. Learned advocate appearing for the petitioner submits that the hearing of the said suit has already been concluded and thereafter the Presiding Officer was transferred. From the order-sheets appended to this application this Court finds that June 9, 2026 was fixed for delivery of judgment. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite-party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite-party or upon the learned advocate representing the opposite-party before the learned trial judge. 2 Since the learned advocate appearing for the petitioner submits that the Presiding Officer has been transferred prior to delivery of judgment, the matter is to be heard afresh in accordance with law. Accordingly, CO 2223 of 2026 stands disposed of by directing that: after the Presiding Officer joins, such Officer shall make an endeavour to dispose of Title Suit No. 312 of 2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
