JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused no.2 in Crime No.51/2026 registered by the Andersonpet Police Station, K.G.F, for the offences punishable under Sections 308(2), 308(3), 352, 351(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.51/2026 was registered by the Andersonpet Police Station, K.G.F., for the aforesaid offences against the Dorai and the petitioner herein based on the first information dated 12.05.2026 received from one Mohammed Sukleane s/o late Jani Basha. In the said case, the petitioner was arrested on 17.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Mis.No.468/2026 was rejected on 09.06.2026. Therefore, he is before this Court. 4. In the first information submitted on 11.05.2026, the alleged victim has stated that he is running a tent house - 3 - HC-KAR CNR: KAHC010398812026 NC: 2026:KHC:36349 CRL.P No. 8374 of 2026 business and petitioner had approached him about two months earlier requesting him to make decorations and install pendal for the purpose of his daughter's engagement. Accordingly, the first informant had installed the pendal and decorated the house of the petitioner for the purpose of the engagement ceremony. However, petitioner had failed to pay money to the first informant. Subsequently, the accused persons once again approached the first informant on 06.05.2026 and asked him to install pendal for the purpose of the marriage of the daughter of the petitioner. When the first informant refused to do so on the ground that they had not paid the money for the earlier decoration done by the first informant, accused No.1 abused him and threatened him with dire consequences, demanded hafta money from him, snatched an amount of Rs.8,000/- from his pocket and went away. In respect of the alleged incident that had taken place on 06.05.2026, first information was belatedly filed on 11.05.2026. 5. Learned counsel for the petitioner has brought to the notice of this Court that except the present case, the petitioner has no other criminal case pending as against him. Accused - 4 - HC-KAR CNR: KAHC010398812026 NC: 2026:KHC:36349 CRL.P No. 8374 of 2026 no.1 has been granted regular bail by this Court in Crl.P.No.7526/2026 disposed of on 10.07.2026. Considering the delay in approaching the police and also the nature of allegations found in the first information, I am of the view that petitioner's prayer for grant of regular bail is to be answered in the affirmative. Accordingly, the following order: 6. Petition is allowed. The petitioner is ordered to be enlarged on bail in Crime No.51/2026 registered by the Andersonpet Police Station, K.G.F, for the offences punishable under Sections 308(2), 308(3), 352, 351(2) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts there appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010398812026 NC: 2026:KHC:36349 CRL.P No. 8374 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed of.
