ORAL ORDER
1. Heard learned counsel appearing for the parties. 2. In this Writ Petition, petitioner sought for a writ of mandamus to direct the respondent-University to refer the petitioner's papers for third evaluation for the subject-Anatomy Paper TP-1 and TP-2 with QP Code 5501 and 5502 (Annexures- D and D1 respectively) and to declare the result afresh. 3. Having taken note of a submissions made by the learned counsel appearing for the parties and also the Notification dated 05.09.2022, placed by the learned counsel appearing for the respondent-University would make it clear that there is no Rule/Regulation providing for the third evaluation of the papers as sought for by the petitioner.
It is also to be noted from the observation made by the Division Bench of this Court in Writ Appeal No.1372/2025 and connected Writ Appeals disposed of on 19.02.2026, wherein this Court has held that the revaluation of the answer scripts by a third Evaluator cannot be accepted. - 4 -

In that view of the matter, following the declaration of law made by the Division Bench as noted above and as well as there is no Rule of the respondent-University providing for the third evaluation or revaluation as sought for by the petitioner, I am of the view that the Writ Petition is not maintainable and accordingly, the Writ Petition is dismissed.
