Mr. Anish Banshtu, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents. 2. In view of the order proposed to be passed in the writ petition, no reply is intended to be called from the respondents. 3. The precise grievance of the petitioner is that he is working as Warder at District-cum-Open Air Jail, Chamba, District Chamba, (H.P), with respondent No. 3 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 since 22.06.2019. His wife is serving as a Staff Nurse and presently posted at IGMC Shimla. 4. Learned counsel for the petitioner submits that the petitioner has made a representation dated 15.10.2025 (Annexure P-1) to respondent No. 2, i.e., the Director General of Prison & Correctional Services, Government of Himachal Pradesh, Shimla, requesting therein to transfer him to Shimla being a couple case. He further submitted that as per the Transfer Policy, the State Government has provided concessions to couples working under the H.P. Government. He laid emphasis on Clause 5.4 of the Transfer Policy, which reads as under:- “In case wife and husband both are working under the State Government, efforts should be made to post them at one place or near places as far as possible, subject to vacancy.” 5. A perusal of Clause 5.4 reveals that, in cases where both wife and husband are working under the State Government, efforts should be made to post them at one place or near places as far as possible, subject to vacancy. Since the petitioner has made a representation dated 15.10.2025 (Annexure P-1) before respondent No. 2, his case is required to be considered in terms of the guidelines issued by the State Government. 3 6. Learned counsel for the petitioner has also submitted that a vacancy of Warder is lying vacant in District Jail Kiathu, Shimla, Himachal Pradesh. 7. Keeping in view the above facts coupled with the clause in Transfer Policy, respondent No. 2 is directed to consider and decide the representation dated 15.10.2025 (Annexure P-1) expeditiously, preferably within a period of four weeks from today. However, before deciding the representation, the petitioner may be heard, and further, the additional facts, if submitted by him, may also be considered by the competent authority. 8. The petition is accordingly disposed of. CMP No. 2195 of 2026 9.
