This application under Article 227 of the Constitution of India is at the instance of the 1st defendant praying for a direction upon the learned Civil Judge (Sr. Division), Durgapur to dispose of Title Suit No. 138 of 2013, expeditiously. Learned advocate appearing for the petitioner submits that the plaintiff/opposite-party filed an application under Order 6 Rule 17 of the Civil Procedure Code which is still pending. He further submits that the suit is at peremptory hearing stage. From the order-sheets appended to this application this Court finds that on several occasions the hearing of the suit was adjourned on the ground of resolution taken by the local Bar Association. It further appears from the order-sheets that on December 11, 2026 both the parties prayed for an adjournment. It appears from the order dated February 18, 2026 that the plaintiff filed an petition under Order 6 Rule 17 of the Civil Procedure Code.
2 In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite-parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite-parties or upon the learned advocate representing the opposite-parties before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioner CO 2220 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), Durgapur to take up the hearing of the application under Order 6 Rule 17 of the Civil Procedure Code on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the said application and any other interlocutory application that may be pending, the learned District Judge shall make an endeavour to dispose of the Title Suit No. 138 of 2013 as expeditiously as possible keeping in mind that the suit is pending from the year 2013.
