(ORAL) Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the “BNSS”) is for the grant of anticipatory bail in case FIR No.130, dated 20.12.2025 under Sections 115 (2), 117 (2), 118 (1), 118 (2), 126 (2), 324 (4), 351 (2), 191, 190, 61(2) of BNS, 2023 registered at Police Station Behrampur District Gurdaspur. 2. On the statement of one Ritik Kumar, the present FIR was registered, the translated version of which is as under:- “Ritik Kumar son of Sham Lal resident of Subeg Singh Nagar Jail Road Opposite Mahindra Green Land Palace Abalkher Police Station Dinanagar aged 25 years Mob: 95920-61033. Stated that I am a resident of the above mentioned address and do my private work and business. On 12.12.25, I had gone to Village Malhian in car bearing number PB35 AK 8492 to meet MANI KUMAR 2026.07.10 19:05 I attest to the accuracy and integrity of this document CRM-M-11390-2026 (O&M) -2- my friend Gurpreet Singh, son of Gopi, resident of Malhian. When I was returning from Village Malhian in my car and coming to my house, the time must have been around 9:30 pm when I reached Village Chuhar Chak a little further near T-point Khudadpur, to which a safari car came from behind whose driver hit my car from behind with his safari car, due to which my car the rear axle of my i-20 car bearing number PB35 AK 8492 colour white got broken and my vehicle got stopped. Meanwhile, Amrik Singh @ Gora son of Kuldeep Singh armed with Kirpan, Harpal Singh @ Sonu son of Lakhwinder Singh armed with Datar, Harmanpreet Singh @ Bittu armed with Datar, Gursewak Singh son of Gurnam Singh armed with Datar, Jagjit Singh @ Jaggi son of Nachhattar Singh armed with Datar, Karandeep Singh son of Sukhwinder Singh armed with Datar, Lovepreet Singh Bhinder son of Satnam Singh armed with Stick, all residents of Malhian and Nissan Singh son of Prem Singh resident of Dalia armed with Baseball Stick came out of the Safari car and came towards me. I already know all these above persons. Gursewak Singh raised a shout that "Catch him. Tell him the joy of being a friend of Gurpreet Singh @ Gopi". Seeing them, I came out of the car and ran towards the Niamata side to which the above persons also run after me along with their weapons, and all these persons surrounded me near a private school. Amrik Singh alias Gora hit blow the Kirpan held in his hand, which hit me on the middle of my head, then Harpal Singh @ Sonu hit blow with the sickle held in his hand, which hit me above my left ear, then Harmanpreet Singh @ Bittu hit blow with the sickle held in his hand, which hit me on the back of my head, then Gursewak Singh hit blow with the sickle held in his hand, which hit me on my left cheek, then Jagjit Singh MANI KUMAR 2026.07.10 19:05 I attest to the accuracy and integrity of this document CRM-M-11390-2026 (O&M) -3- @ Jogi hit blow with the sickle held in his hand, which hit me on the left side of my neck, then Karandeep Singh hit blow with the sickle held in his hand, which hit me on the wrist of my left arm, and Lovepreet Singh @ Bhinder hit blow with Stick held in his hand, which hit me on my left eye, and then Nissan Singh hit blow with the baseball stick held in his hand, which hit me on my right thigh and I fell down on the ground and started shouting. To which the above said assailants ran away from the spot while abusing and threatening me and while escaping, they also destroyed my car number PB35 AK 8492. I called my father Sham Lal on his phone number 95011-72791 from my mobile phone and told him about the incident. My father then called my friends Gurpreet Singh Gopi and Gurdev Singh alias Rana, residents of Behrampur, on their phones and told them about the incident. After a while, my friends Gurpreet Singh Gopi and Gurdev Singh alias Hana arrived at the spot in their vehicle and took me to the Civil Hospital at Gurdaspur. My father Sham Lal also reached at the Civil Hospital in Gurdaspur where I was admitted to the Civil Hospital and the Doctor Sahib made my MLR and after applying bandage, referred me further considering my condition critical. Upon which my father took me to Abrol Hospital Gurdaspur and admitted me there. The doctor started my treatment where I am undergoing treatment. Later I came to know that the vehicle used by the above mentioned persons during the fight was Safari bearing number PB08BZ0765. Amreek Singh @ Gora; Harpal Singh @ Sainu, Harmanpreet Singh @ Bittu, Gursewak Singh, Jagjit Singh @ Jaggi, Karandeep Singh, Lovepreet Singh @ Bhinder resident of Malhian and Nissan Singh resident of Dalia, in connivance with each other, armed with weapons and hit my vehicle, destroyed it, MANI KUMAR 2026.07.10 19:05 I attest to the accuracy and integrity of this document CRM-M-11390-2026 (O&M) -4- surrounded me and beaten up. The enmity behind this is that Gurpreet Singh @ Gopi resident of Malhian is my friend whose house I frequently use to come and go. All the above mentioned persons (accused) are against this. Legal action should be taken against all the above mentioned persons. Statement has been written, read over and heard and found to be as correct. Sd/-Ritik Kumar Signature in English.” 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that though a specific role has been attributed to the petitioner in the FIR, the MLR does not specify as to which injury had been caused with which weapon. Learned counsel submits that the petitioner is willing to join investigation and abide by any condition imposed by the Court. 4. Per contra, learned State counsel and learned counsel for the complainant have opposed the bail application, stating that a very serious offence was committed and the complainant suffered a number of grievous injuries. Learned counsel for the complainant submits that the treating hospital had declared the injuries to be dangerous to life but the Civil Hospital has not taken into consideration the said opinion of the treating hospital. He submits that under the circumstances, an application in this regard has been moved before the area Magistrate which is pending consideration. 5. I have considered the submissions made by learned counsel for the parties. 6. A very serious incident took place on 12.12.2025 when the car being driven by the complainant was struck from behind by a Safari car from which many persons including the petitioner alighted. The allegation against the petitioner is that he struck the complainant on the back of the head with a Datar. The complainant is lucky to have survived. Keeping in view the gravity of the allegations, this Court does not find it to be a case in which the concession of anticipatory bail should be extended. 7. That being so, the petition is found to be devoid of merit and is accordingly dismissed.
