JUSTICE RITESH KUMAR ORAL ORDER 3 31-07-2026 Heard the learned counsel for the petitioners and the learned A.P.P. appearing on behalf of the State. 2. The petitioners apprehend their arrest in connection with Rupo @ Rupau P.S. Case No.137 of 2025 for allegedly having committed offences under Sections 191(2), 190, 126(2), 115(2), 109, 303(2), 352 and 351(2) of the B.N.S. 3. As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant, to the effect that all the accused persons, including the petitioners came armed variously like tangi, stick, iron khanti and surrounded the brother of the informant. It has been alleged that co-accused, Patna High Court CR. MISC. No.42635 of 2026(3) dt.31-07-2026 2/4 Mukesh Manjhi assaulted on the head of the brother of the informant with a tangi and then co-accused, Manoj Manjhi also assaulted on the head of the brother of the informant with an iron khanti. Thereafter all the accused persons assaulted the brother of the informant with iron khanti and stick and upon hulla, the petitioners no.1 and 2 along with co-accused, Balam Manjhi as well as 8-9 unknown persons brutally assaulted the brother of the informant and when they thought that the brother of the informant has died, they thrown him in the field and gold ornament to the tune of Rs.30,000/- was also taken away. The brother of the informant was taken to hospital for treatment. 4. The learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. He submits that as per the First Information Report itself, it would transpire that allegation of assault on the head of the brother of the informant has been levelled against co-accused, Mukesh Manjhi and Manoj Manjhi and so far the other accused persons, including the petitioners are concerned, general and omnibus allegation of assault with iron khanti has been levelled. He further submits that for the same occurrence, wife of co-accused, Mukesh Manjhi has also lodged Repau P.S. Case No.138 of 2025 against the informant and his family members. He submits that the petitioners have go a clean antecedent. Patna High Court CR. MISC. No.42635 of 2026(3) dt.31-07-2026 3/4 5. Per contra, the learned counsel appearing on behalf of the informant, while opposing the prayer for grant of anticipatory bail to the petitioners, submits that all the petitioners brutally assaulted the informant’s brother, due to which he sustained various injuries and the injuries have been found to be grievous in nature by the treating doctor. It is also submitted that they literally thought the brother of the informant to be dead and then they fled away, therefore they do not deserve the privilege of anticipatory bail. 6. The learned A.P.P. appearing on behalf of the State also opposes the prayer for grant of anticipatory bail to the petitioners and submits that allegation of assault with iron khanti has been levelled against all the accused persons upon the brother of the informant. 7. Having considered the rival submissions and after going through the records as well as the injury report, which has been annexed with the case diary, it would transpire that the treating doctor has found mild soft tissue hematoma with emphysema in right frontoparietotemporal region, apart from fracture of shaft of right ulna. He found the injuries to be grievous in nature. From the First Information Report, it would transpire that specific allegation of assault on the head of the informant has been levelled against co-accused, Mukesh Manjhi and Manoj Patna High Court CR. MISC. No.42635 of 2026(3) dt.31-07-2026 4/4 Manjhi and so far the petitioners are concerned, general and omnibus allegation of assault has been levelled. 8. Taking into consideration the facts aforesaid, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-5th, Nawada in connection with Rupo @ Rupau P.S. Case No.137 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court concerned shall take steps for cancellation of their bail bonds. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification. Sanjay/- (Ritesh Kumar, J.) U T
