ORAL ORDER Accused No.2 to 4 in Crime No.122/2026 registered by Hennur Police Station, Bengaluru City for the offences punishable under Sections 80, 85, 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961 are before this Court in these two petitions under Sections 483 and 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking regular bail and anticipatory bail respectively.
2. Heard the learned counsel for the petitioners and learned High Court Government Pleader appearing for the respondent - State.

3. FIR in Crime No.122/2026 was registered by Hennur Police Station, Bengaluru City for the aforesaid offences against Kiran Kumar and the petitioners herein based on the first information dated 09.03.2026 received from Smt.Tejavathy, the mother of the deceased Smt.Supritha. During the course of investigation, accused No.2 who is the mother-in-law of deceased was arrested 09.03.2026 and remanded to judicial custody.
4. Bail application filed by accused No.2 before jurisdictional Sessions Court in Criminal Miscellaneous No.3769/2026 was rejected on 21.05.2026. Therefore, she is before this Court in Criminal Petition No.7589/2026 seeking regular bail.
5. Accused No.3 and 4, the sister and brother-in-law of accused No.1 had approached the jurisdictional Sessions Court in Criminal Miscellaneous No.2723/2026 seeking anticipatory bail. Said petition was rejected on 17.04.2026. Therefore, they are before this Court in Criminal Petition No.6396/2026 seeking anticipatory bail.

Learned counsel for the petitioner submits that allegation as against accused No.2 to 4 are omnibus in nature. Accused No.2 who is a married woman aged about 55 years is in custody for more than 3 months. Accused No.3 and 4 are residing separately with their family at Devanahalli and only for the reason that they are relatives of accused No.1, they have been falsely implicated in the present case.
7. Per contra, learned High Court Government Pleader appearing for the respondent - State who has opposed the petition, submits prima facie case is found against accused No.2 to 4 and accordingly, prays to dismiss the petition.
8. Accused No.1 is the son of accused No.2 and brother of accused No.3. Accused No.4 is the husband of accused No.3. It appears that marriage of deceased Supritha was performed with accused No.1 on 25.02.2021. In the first information submitted on 09.03.2026 after Supritha had committed suicide, it is alleged that accused persons were demanding dowry from the deceased and in furtherance of

such demand, they were torturing the deceased in her matrimonial house. It is also alleged that accused No.1-Kiran Kumar, husband of deceased was in the habit of consuming alcohol and thereafter used to abuse his wife in furtherance of the demand for dowry. Undisputedly, no criminal case is registered against the accused persons during the lifetime of deceased Supritha.
9. Accused No.2 is a married lady aged about 55 years and she is in custody for last more than three months. Investigation of the case is completed and charge sheet has now been filed. Accused No.1, who is the husband of deceased is arrested and is in judicial custody. Accused No.3 is the sister of accused No.1 and accused No.4 is the brother-in-law of accused No.1. Material on record would go to show that accused No.3 and 4 are residing separately at Devanahalli, whereas the incident in question has taken place in the house of accused No.1, within the jurisdiction of Hennur Police Station.

10. Under these circumstances, I am of the opinion that the prayer made by the petitioners has to be answered in the affirmative. Accordingly, the following:
ORDER Criminal Petition No.7589/2026
(i) The Criminal Petitions are allowed.
(ii) The petitioner/accused No.2 is directed to be enlarged on bail in Crime No.122/2026 registered by Hennur Police Station, Bengaluru City for the offences punishable under Sections 80, 85, 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court

unless the Trial Court exempts her appearance for valid reasons; c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioner shall not involve in similar offences in future; e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against her is disposed off. The respondent - Police or any other Police in the State of Karnataka are directed to release the petitioners/accused No.3 and 4 in the event of their arrest in Crime No.122/2026 registered by Hennur Police Station, Bengaluru City for the offences punishable under Sections 80, 85, 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961, subject to the following conditions:

a) Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (One lakh only) each, with two sureties each, for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon. d) Petitioners shall not involve in similar offences in future.
