ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH)
The present intra-Court appeal under Section 4 of the Karnataka High Court Act, 1961, has been filed impugning the further interim order dated 10.04.2026 passed by the Writ Court in W.P.No.18923/2025 on I.A.No.3/2025 filed by the respondent, whereby the compensation paid to the appellant by the Special Land Acquisition Officer1 has been
directed to be deposited back.

2. Earlier to the impugned
order dated 10.04.2026, the Writ Court vide order dated 30.06.2025
directed the SLAO not to release any further amount in favor of any party.
3. Before the said order dated 30.06.2025, the SLAO had already released Rs.28,00,00,000/- in favor of the appellant, out of total compensation determined in respect of the land in question of Rs.160 Crores.
4. The matter is still subjudiced before the Writ Court. The interim compensation of Rs.28,00,00,000/- released in favor of the appellant has been indemnified by the appellant by executing an Indemnity bond. Even otherwise, if the Writ Court ultimately finds that the appellant is not entitled for any compensation, the appellant has to deposit back the amount of compensation released in her favor along with interest.
5. The amount of compensation released in favor of the appellant pursuant to the order dated 27.05.2025

passed by the SLAO, would be subject to the final outcome of the Writ Petition. Therefore, at this stage, when the SLAO had released the amount of compensation prior to passing of the interim order dated 30.06.2026, it does not appear justified to direct the appellant to deposit it back. However, we make it clear that no further amount shall be released to any party as directed by the Writ Court vide first interim order dated 30.06.2025 and the amount released in favor of the appellant shall be subject to the final outcome of the Writ Petition.
6. If the Writ Court finds that the appellant is not entitled for any compensation, the appellant would be required to refund the amount of compensation received by her along with interest.
7. Let the Writ Court decide the matter finally. All
contentions of the parties are kept open. Accordingly, the Writ Appeal is disposed of.
