1. The present writ petition has been filed by the petitioner being ag- grieved by the order dated 27.11.2018 passed by the Chief Executive Officer, Janpad Panchayat, Dharamjaigarh, annexed as Annexure P/1. Digitally signed by JYOTI JHA Date: 2026.07.23 16:56:37 +0530
2 The petitioner is also aggrieved by the order dated 04.10.2018 passed by the Project Officer, Integrated Child Development Project, Dharam- jaigarh, annexed as Annexure P/2, whereby the representation sub- mitted by the petitioner pursuant to the directions issued by this Hon'ble Court in WPS No. 5174/2018 vide order dated 13.08.2018 vide Annex- ure P/3, has been rejected.

Learned counsel for the petitioner submits that the petitioner was ap- pointed as an Anganwadi Worker against a sanctioned post and has been continuously working on the said post since her appointment. It is argued that despite this, the respondents have been paying her the re- muneration admissible to an Anganwadi Helper instead of that payable to an Anganwadi Worker. It is further submitted that the impugned or- ders rejecting the petitioner's claim on the ground that her appointment as an Anganwadi Worker was made by mistake are contrary to the ap- pointment order and other contemporaneous records. It is, therefore, prayed that the impugned orders be quashed and the respondents be
directed to grant the petitioner the remuneration and all consequential benefits admissible to an Anganwadi Worker.

Learned State counsel supports the impugned orders and submits that the petitioner's representation has been duly considered and decided by the competent authorities in compliance with the directions issued by this Court. It is contended that no illegality or arbitrariness has been committed in passing the impugned orders, and therefore, the writ peti- tion being devoid of merit deserves to be dismissed.
4. I have learned counsel for the parties and perused the records.
5. This Court, vide order dated 13.08.2018 passed in WPS No. 5174 of 2018, directed that, "in case the respondents reach the conclusion that the petitioner was appointed as an Anganwadi Worker, the petitioner would be entitled to the entire arrears of the differential amount."

3 finding that the petitioner was appointed as an Anganwadi Helper and, therefore, is not entitled to the arrears of the differential amount. This court is of the opinion that the said finding of fact is based on the mate- rial available on record and is neither perverse nor contrary to the record. Accordingly, the present writ petition, being devoid of merit, de- serves to be and is hereby dismissed. Sd/-
